The Supreme Court of India on Friday has overturned a contentious order by the Andhra Pradesh High Court, which had previously issued severe criticisms against both the Supreme Court Collegium and Chief Minister YS Jagan Mohan Reddy. This ruling, delivered by a bench comprising Justices Bela M. Trivedi and Justices Pankaj Mithal, effectively nullifies the disparaging remarks made by the High Court, thereby quelling a significant legal controversy that had stirred the judicial and political spheres alike.

The origin of this dispute can be traced back to a December 31, 2020, judgment authored by Justice Rakesh Kumar of the Andhra Pradesh High Court. Justice Kumar’s ruling was in response to a recusal application from the State government, which sought his withdrawal from a case challenging the auction of state lands. In his observations, Justice Kumar did not mince words, expressing profound disapproval of the Supreme Court Collegium’s decisions regarding the transfer of two Chief Justices. Furthermore, he lambasted the administration led by Chief Minister YS Jagan Mohan Reddy for what he perceived as efforts to undermine the High Court’s authority.

Justice Kumar’s criticisms extended beyond the Collegium and the Chief Minister, touching on broader issues of judicial integrity and governance. He lamented the delay in resolving criminal cases against the Chief Minister and highlighted a concerning trend where influential individuals seemed to believe they could act with impunity, to the detriment of the system and the disadvantaged. The High Court, according to Justice Kumar, faced significant challenges in safeguarding the fundamental rights of Andhra Pradesh’s citizens, a task he described as increasingly difficult.

Moreover, Justice Kumar called for greater transparency within the Supreme Court Collegium and suggested that High Court judges, who also occupy constitutional positions, should be given due consideration. He advocated for a period of at least one year post-retirement before judges could entertain any post-retirement engagements, aiming to preserve the judiciary’s independence.

This Supreme Court ruling not only addresses the immediate legal matter at hand but also sends a clear message regarding the sanctity of judicial discourse and the boundaries of critique within the judiciary. Justice Rakesh Kumar, the figure at the center of this controversy, is no stranger to judicial disputes. His transfer to the Andhra Pradesh High Court from the Patna High Court was marked by outspoken remarks against perceived corruption within the judiciary. These comments, made in the context of a case involving the Bihar Mahadalit Vikas Mission fund scam, led to significant pushback within the judicial community, including a temporary withdrawal of judicial work from him, followed by a reassignment.
