This endorsement underscores the government’s commitment to fostering a culture of accountability and ensuring that political processes remain free from corruption, thereby advancing the nation’s democratic ideals.
The verdict was pronounced by a bench comprising CJI DY Chandrachud, Justices AS Bopanna, MM Sundresh, PS Narasimha, JB Pardiwala, Sanjay Kumar and Manoj Misra.
Today, the Supreme Court declared that Members of Parliament (MPs) and Members of the Legislative Assembly (MLAs) do not enjoy immunity from prosecution for receiving payments to deliver speeches or cast votes in the legislature. The court emphasized that parliamentary privileges do not extend to protecting bribery. Additionally, the court ruled that MLAs accepting payments for voting in Rajya Sabha elections can face penalties under the Prevention of Corruption Act (PCA).
In a unanimous decision by a seven-judge panel, the court overturned a previous ruling by a five-judge panel in the PV Narasimha Rao case. The court found that the earlier judgment in the PV Narasimha Rao case created a contradictory situation where lawmakers who accepted bribes and voted accordingly were shielded, while those who, despite accepting bribes, voted independently were still liable to prosecution.
