The woman had accused her husband of subjecting her to physical and mental harassment regarding dowry. Subsequently, she filed a petition in the family court seeking spousal support.
Conversely, the man lodged a complaint claiming that she harassed him following their marriage and requested alimony. He asserted that his unemployment stemmed from discontinuing his studies due to his wife’s actions.
Aman’s(Husband) attorney, Manish Jharola, stated that after hearing both parties, the court directed the woman to provide her husband with a monthly payment of Rs 5,000. Inconsistencies arose in her testimony; initially, she informed the police of running a beauty parlour. However, in court, she claimed to be unemployed, asserting that her husband was the sole breadwinner.
Due to the lack of substantial evidence, the family court mandated the woman to pay the specified monthly sum to her estranged spouse.
According to Manish Jharola, this case potentially marks the first instance in Madhya Pradesh where a wife has been instructed to provide maintenance to her husband. He further noted that in prior cases involving physical and mental abuse, it’s typically the wife who receives maintenance.
The lawyer elaborated that Aman, a Ujjain resident, first encountered the woman in 2020. Their relationship blossomed, leading to her proposal of marriage after a few months. Nevertheless, Aman declined her proposal, explaining that he was still in 12th grade and intended to marry only after completing his education.
Jharola mentioned that the woman resorted to blackmail, threatening to commit suicide if Aman didn’t agree to marry her. Consequently, they wed at an Arya Samaj temple in July 2021. Following their marriage, the couple took up residence in a rented house in Indore. However, Aman claimed that within a month of their wedding, the woman began subjecting him to physical and emotional abuse.
Deciding to leave, Aman returned to his parents’ home within two months of the marriage. Subsequently, the woman filed a missing person report at the police station and initiated a dowry harassment case against Aman in the family court. Additionally, she sought maintenance from him.
In response, Aman lodged a police complaint against his wife and filed a petition in the family court seeking maintenance. He explained to the court that due to unemployment, he couldn’t afford alimony.
The court ruled in his favor, instructing the woman to pay him Rs 5,000 per month.
