New Delhi: The Delhi High Court has made it clear that victims of sexual assault, especially children, have their own rights under the law. These rights cannot be ignored just because their parents have decided to settle their issues privately. The order was recently passed by a bench led by Justice Swarna Kanta Sharma. The judge stressed that the legal system gives top priority to the rights of children.
The Supreme Court reaffirmed the conviction of an accused in a 1984 rape case, stating that the absence of injuries on the victim’s private parts does not automatically weaken the prosecution’s case. The court dismissed an appeal challenging the previous decision, which had upheld the conviction under Sections 376 (rape) and 323 (voluntarily causing hurt) of the IPC. Emphasizing the importance of overall evidence, the court ruled that physical injuries are not the sole determinant of sexual assault cases.
NEW DELHI: On Tuesday, 18th Feb: the Supreme Court dismissed the petition filed by Sukesh Chandrashekhar, an alleged conman, who had asked for a transfer from Delhi’s Mandoli jail to a prison in his home state of Karnataka, or any nearby state. A Bench of Justices Bela Trivedi and PB Varale gave their decision, emphasizing that the accused, in this case, had caused harm to society, and the Court also had to consider the rights of the victims.
