The Supreme Court dismissed a Rajasthan man’s plea challenging an eviction order under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, while strongly criticising his dispute with his elderly father and urging him to care for and support his parent.
The Delhi High Court stayed the eviction of a daughter-in-law from her shared household, holding that the Senior Citizens Act cannot override a woman’s right of residence under the Domestic Violence Act, in line with the Supreme Court’s ruling in S. Vanitha.
The Bombay High Court has ruled that parents cannot seek eviction of their children under the Senior Citizens Act without proving neglect or claiming maintenance, warning against misuse of the law for property disputes and possession battles.
