The Supreme Court held that “just compensation” under the MV Act goes beyond strict mathematical calculation, aiming to provide solace for irreparable loss. It observed that the value of a young life and a family’s grief cannot be fully measured in monetary terms.
The Karnataka High Court ruled that compensation for medical expenses under the Motor Vehicles Act must deduct amounts received through mediclaim policies. Hanumanthappa’s initial compensation was reduced from Rs 6.73 lakh to Rs 4.93 lakh after Rs 1.8 lakh, received via mediclaim, was subtracted from the awarded medical expenses.
