A road accident victim filed his motor accident claim at Chennai because the insurer had an office there, though he lived in Chittoor and the accident happened in Tirupati. The Supreme Court held that under Section 166(2) of the Motor Vehicles Act, an insurer’s place of business does not confer territorial jurisdiction on a Claims Tribunal, unlike a suit under the CPC, and upheld the transfer of the claim to Chittoor.
The Madhya Pradesh High Court held that an insurer cannot deny compensation for a pillion rider’s death merely because she was the vehicle owner’s wife. The Court ruled she remains a third party under the Motor Vehicles Act, 1988.
