The Chhattisgarh High Court ruled that a father living with a second wife without legally divorcing his first wife commits “misconduct” and “cruelty,” holding that child welfare prevails over financial capacity while denying him custody.
The Supreme Court set aside High Court orders and upheld the dismissal of a CISF constable for contracting a second marriage, stressing that courts cannot act as appellate authorities in disciplinary matters. Invoking “dura lex sed lex”, the Court held that hardship cannot override clear statutory rules governing disciplined forces.
Today, On 16th December, Supreme Court issued notice to the Lok Sabha Speaker and Parliament secretariats on Justice Yashwant Varma’s plea challenging constitution of a three-member inquiry committee. While flagging procedural lapses, the Court questioned how such an oversight occurred during impeachment proceedings.
The Supreme Court panel has called for Justice Yashwant Varma’s removal after finding substantial evidence of misconduct, including testimonies from 10 eyewitnesses who saw cash in his residence. A total of 55 testimonies corroborated the allegations, emphasizing concerns about judicial integrity and the seriousness of unexplained cash at his official domicile.
The Allahabad High Court temporarily stayed the suspension of IPS officer Mohsin Khan, accused of sexually harassing an IIT Kanpur student. The court ruled that his alleged actions do not constitute gross misconduct under government rules. The state government must respond within four weeks, with the next hearing scheduled for July 28, 2025.
