The Supreme Court has transferred a PIL on the implementation of the Mental Healthcare Act, 2017, to the National Human Rights Commission (NHRC). The NHRC will now oversee compliance to protect the rights and dignity of persons with mental illnesses across India.
The Supreme Court called rehabilitation of homeless persons with psychosocial disabilities a “sensitive issue” and told the Centre to act urgently. It questioned the poor execution of existing mental health laws.
Today, On 18th July, The Supreme Court has added NHRC to a PIL concerning the 2017 Mental Healthcare Act, stating, “We cannot create a parallel mechanism just because the existing system has any flaws.” The case will now proceed accordingly.
The Madras High Court authorized the wife of a comatose patient to sell his property for medical expenses. The court appointed her as the guardian, allowing her to manage the property and use the proceeds for the patient’s care. The decision was made under the court’s writ jurisdiction, in absence of statutory remedy for such cases.
