The Allahabad High Court has quashed a 2020 FIR and charge-sheet against two men accused of returning from the Nizamuddin Markaz and allegedly risking the spread of COVID-19, holding that they were falsely implicated on the basis of presumption and assumption and with an ulterior, malafide motive, particularly as their COVID tests had turned negative. Applying the Bhajan Lal categories, the Court held that allowing the proceedings to continue would be an abuse of the process of the court.
The Allahabad High Court has granted protection to a same-sex couple in a live-in relationship, holding that two consenting adults have a fundamental right under Article 21 to live together peacefully, irrespective of their sexual orientation or of social and family opposition.
