Justice Rajesh Bindal warns that rising infrastructure disputes demand expert-led, faster arbitration systems. He calls for stronger institutions, better contracts, and tech-ready dispute resolution to prevent project delays.
Justice Manmohan of the Supreme Court said, “Courts must support arbitration, not act as a barrier,” while urging Law Minister Arjun Ram Meghwal at the IDRC Conclave 2025 to reconsider the Finance Ministry’s directive restricting arbitration in disputes above Rs 10 crore.
The Supreme Court has upheld a tribunal’s discretion to condone Doosan Power’s 84-day delay in filing its defence, ruling that arbitral rules “are meant to guide and not bind.” The Court rejected Aneja Constructions’ plea, affirming party autonomy remains subject to fairness and justice.
Law Minister said institutional arbitration aligns with Indian culture and must be encouraged. He added, “India would soon become a leading hub for such arbitration,” highlighting the country’s growing role in global dispute resolution systems.
CJI B.R. Gavai, speaking at a London summit, proposed four urgent reforms for India’s arbitration: ensuring finality of awards, promoting institutional arbitration, enforcing stricter timelines to prevent delays, and increasing diversity among arbitrators. His vision aims to enhance India’s arbitration landscape, making it more efficient, reliable, and inclusive.
NEW DELHI: The Union Law Ministry has revealed that the Central government has provided financial support of Rs.7.5 crore over the past three years to the India International Arbitration Centre (IIAC). This funding aims to promote and strengthen institutional arbitration in India. This information was shared by Minister of State for Law and Justice Arjun Ram Meghwal in response to questions raised in the Rajya Sabha by Aam Aadmi Party (AAP) MP Sanjeev Arora.
Justice P.S. Narasimha, born on May 3, 1963, assumed office as a Supreme Court Judge on August 31, 2021. He has authored 59 judgments and notably contributed to landmark cases and legal reforms. He will become Chief Justice of India in October 2027, being appointed directly from the bar.
