The Delhi High Court dismissed appeals filed by Masarat Alam, Shabir Shah and others against the order framing charges in a J&K terror funding case under UAPA. The Court held such appeals are barred under Section 21 of the NIA Act as they challenge interlocutory orders.
A Delhi court has denied the bail plea of Lok Sabha MP Engineer Rashid, arrested in 2019 for his involvement in a 2017 terror funding case related to militant activities in Jammu and Kashmir. The NIA argued against his release, citing that he should not exploit his MP status to evade imprisonment.
The NIA seeks to transfer the case of Engineer Rashid from the MP/MLA court to a Special NIA Court, arguing against potential trial delays. Senior Advocate Siddharth Luthra stated it would take ten days for a High Court response. Rashid, arrested under UAPA in 2019, recently secured an election victory while in custody.
