Sunjay Kapur’s children, Samaira and Kiaan, have moved court seeking criminal action against Priya Kapur, alleging fabrication of their father’s will, sources said. They claim serious loopholes in the digital trail and have sought seizure of devices, which could turn the inheritance dispute into a criminal case.
The Supreme Court has set aside the Madras High Court order that quashed criminal proceedings in a family property dispute involving alleged forgery and cheating. The Court held that even if a civil court has upheld documents, criminal prosecution can continue where fraud allegations exist.
The Bombay High Court, while hearing a defamation dispute between a brother and sister, stressed that siblings should learn to give up conflicts instead of resorting to litigation. The Court observed that such family disputes only clog the judicial system and destroy precious relationships.
The Kerala High Court ruled that a daughter born within four months of marriage is legally presumed to be legitimate and entitled to an equal share in her father’s property. The Court set aside a trial court decree, holding that conception before marriage does not defeat the presumption of legitimacy under law.
