Allahabad High Court Holds Doctrine Of Necessity Can Save Administrative Exercise From Becoming Futile

The Allahabad High Court has held that the doctrine of necessity is not confined to bias and can be invoked to save an administrative exercise from becoming futile, upholding a Principals select list declared by the Board Chairman alone and dismissing the batch of petitions.

Today, On 19th February, The Supreme Court of India has stayed the Madras High Court order that halted the Tamil Nadu Waqf Board’s powers. It stated, “Issue Notice… board has been made defunct is stayed, and the state government must propose constitution.”
