Patanjali has appealed a Delhi HC order that forced it to remove lines like “Why settle for ordinary Chyawanprash made with 40 herbs?” from its ads. Dabur alleged the campaign disparaged its product, while Patanjali claims it was mere puffery and fair advertising.
The Calcutta High Court ruled that Dabur’s advertisement with Ranbir Kapoor for ‘Cool King’ does not disparage Emami’s products. The Court dismissed Emami’s appeal, stating that the term “Sadharan” is not insulting. The judges emphasized the importance of commercial freedom, highlighting that Emami lacked strong proof for their claims.
