Delhi High Court ruled that a healthy man can’t avoid paying maintenance by citing joblessness. Rs 50,000 monthly support upheld for wife and child under Section 125 CrPC.
New Delhi: The Supreme Court of India ruled that a woman is entitled to claim maintenance from her second husband under Section 125 of the Criminal Procedure Code (CrPC), even if her first marriage is legally still valid. A bench comprising Justices B V Nagarathna and Satish Chandra Sharma upheld the plea of a woman against a 2017 High Court ruling. The High Court had denied her maintenance on the grounds that her first marriage was legally subsisting. However, it had allowed maintenance for the daughter born from her second marriage.
Today, On 12th July, The Calcutta High Court urged the West Bengal government to provide equal child care benefits to male and female employees, emphasizing the need for gender equality in workplace policies. This recommendation stemmed from a petition by a male primary school teacher seeking extended child care leave after his wife’s passing, highlighting the shared responsibility of parents in caring for their children.
