The Centre told the Delhi High Court that directing reduction of GST on air purifiers would be unconstitutional and violate the doctrine of separation of powers. It said Article 279A vests authority over GST decisions in the GST Council.
The Delhi High Court has asked the GST Council to meet urgently to consider reducing GST on air purifiers from 18% to 5% amid the severe air pollution crisis. The Court said lowering tax is the minimum relief when citizens are struggling to breathe clean air.
The Delhi High Court criticised the Centre over Delhi’s worsening air pollution and suggested reducing the 18% GST on air purifiers as minimum relief. The Court called the situation a public health emergency and sought urgent instructions from the government.
The Supreme Court of India upheld the ban on firecrackers in Delhi-NCR due to persistent high air pollution levels. Emphasizing the right to health under Article 21 of the Constitution, the court stated that alternatives like “green crackers” must prove minimal pollution before reconsideration. It recognized the severe pollution crisis as an extraordinary situation warranting the ban.
