If a Man Had Written All This Nonsense, We Would Have Him Arrested: Supreme Court Slams Woman Lawyer Over Derogatory FB Post

Today, On 11th December, The Supreme Court reprimanded a woman lawyer for a derogatory Facebook post targeting another woman who accused Kerala Congress MLA Rahul Mamkoottathil of rape. The Court said, “Had it been a man who had written all this nonsense, we would have got him arrested here itself.”

The Supreme Court reprimanded a woman lawyer on Wednesday for making a “derogatory” Facebook post about another woman who accused Kerala Congress MLA Rahul Mamkoottathil of rape.

A bench consisting of Chief Justice Surya Kant and Justice Joymalya Bagchi expressed strong disapproval of the language and tone used in the post, stating,

“Being a lady, what sort of comments have you made about other women… Had it been a man who had written all this nonsense, we would have got him arrested here itself.”

The lawyer, Deepa Joseph, was concerned about being arrested by Kerala Police due to her social media remarks.

The Chief Justice questioned the appropriateness of her language, asking,

“Are you expected to write in this type of language? You are an advocate.” Joseph claimed her post was based on information from the complainant’s husband and argued that it was not defamatory.

The CJI further challenged her, saying,

“Do we expect a practising woman advocate to write all these things?”

The bench emphasized that her words were derogatory towards another woman, asking how she could express such views about a fellow woman.

They inquired,

“You have not spared a single word in your dictionary. And still you are not regretting! Should we read out in public what you have written?”

The bench also questioned whether the lawyer was hired by the complainant’s husband to publish “all this nonsense,” to which she replied, “It is not nonsense, Sir.”

Ultimately, the bench dismissed her plea and suggested she seek relief from the high court.
