Thank you for reading this post, don't forget to subscribe!NEW DELHI: The Supreme Court today dismissed a petition filed by two lawyers, challenging an order from the Gujarat High Court that called for an investigation into allegations of forgery of a vakalatnama against them.
The bench, comprising Justices BR Gavai and Sandeep Mehta, decided against intervening in the ongoing probe at its current juncture.
The lawyers in question, represented by Senior Counsel Mukul Rohatgi and Yatin Oza, had contested the High Court’s directive, arguing that the decision was made in undue haste. They claimed that the High Court accepted the allegations without seeking any preliminary verification report.
Their plea highlighted concerns that the High Court’s decision was not only unnecessary but also overlooked the lawyers’ fundamental right to practice their profession, as guaranteed under Article 19 of the Indian Constitution. Furthermore, they argued that their rights to reputation and dignity, protected under Article 21, were disregarded.
The High Court’s contentious order was issued by Justice Hasmukh D Sathar amid proceedings related to the release of a vehicle seized under the Gujarat Prohibition Act. During these proceedings, the complainant asserted that they had never appointed Sandipkumar M Patel and Viral J Vyas as their legal representatives.
In response to these allegations, the High Court mandated an investigation to be carried out by an official at least at the level of the court’s Deputy Registrar, aiming to uncover the truth behind the accusations of forgery. This directive from the High Court has now been upheld by the Supreme Court, allowing the investigation against the two advocates to proceed.
