The Supreme Court on Friday (June 28th) directed the Uttar Pradesh (UP) government to expeditiously take a decision on the remission plea by former Member of Legislative Assembly (MLA) Uday Bhan Singh, who had been convicted in a 1999 triple-murder case.
Thank you for reading this post, don't forget to subscribe!NEW DELHI: On Friday, the Supreme Court instructed the Uttar Pradesh (UP) government to swiftly decide on the remission plea of former Member of Legislative Assembly (MLA) Uday Bhan Singh, who was convicted in a 1999 triple-murder case.
A vacation Bench consisting of Justices Abhay Oka and Ahsanuddin Amanullah issued this directive in response to a contempt petition filed by Singh. The Court emphasized,
“We expect the respondent to make immediate compliance with the order dated 29th April, 2024 and place the order passed on record.”
On April 29, a Bench of Justice Oka and Justice Ujjal Bhuyan had overturned the State’s decision to deny remission to Singh, a former Bahujan Samajwadi Party (BSP) MLA, based on his conviction for three murders. The Court noted that three other convicts in similar circumstances had already been granted remission.
Consequently, the Court directed the UP government to reconsider Singh’s request for early release from prison.
Despite this directive, no action was taken by the government, prompting Singh to file a contempt of court petition, alleging non-compliance with the Supreme Court’s order.
During Friday’s hearing (June 28), Singh’s counsel informed the Court that Singh has already served 20 years and 7 months in jail. The counsel argued that despite the Supreme Court’s clear directive on April 29, the State had not made a fresh decision regarding Singh’s plea for remission.
The Supreme Court, noting the delay, issued a notice to the State government and ordered it to immediately decide on Singh’s remission plea. The Court further stated,
“In the meanwhile, we extend the interim bail granted to the petitioner under order dated 29th April, 2024 till the returnable date (July 26).”
This decision underscores the Supreme Court’s insistence on adherence to its directives and the prompt consideration of remission requests, particularly in cases where other similarly placed convicts have been granted such relief.
