NEW DELHI: The Supreme Court is set to adjudicate on a critical appeal from Hemant Soren, the former Chief Minister of Jharkhand, who is contesting a Jharkhand High Court ruling that currently restricts his participation in the forthcoming assembly session on April 1. This pivotal legal proceeding underlines a significant intersection of judiciary power and legislative rights.

Soren’s legal battle escalated after the Prevention of Money Laundering Act (PMLA) court and subsequently, the Jharkhand High Court, dismissed his requests to join the Budget session of the Assembly. In response, Soren escalated his plea to the apex court, filing a special leave petition (SLP), which will now be evaluated by a bench comprising Justices Surya Kant and KV Viswanathan.

The heart of Soren’s argument lies in his statement,

“The High Court’s order was not fair and demanded that he should be allowed to attend the Assembly session to be convened in the coming days.”

This statement reflects his contention that the judicial decision undermines his legislative participation and rights.

The backdrop to this legal tangle is marked by the former Chief Minister’s arrest on January 31 by the Enforcement Directorate, amidst allegations of a money laundering case connected to a purported land scam. The arrest followed an intensive seven-hour interrogation session with Soren at his Ranchi residence, culminating in his resignation from the chief ministerial position.

Despite his legal challenges, Soren was granted a one-time permission to attend a crucial trust vote on February 5, an allowance that contrasts sharply with the ongoing prohibition from the budget session as directed by the Jharkhand High Court on February 28.

This legal confrontation has attracted considerable attention, not only due to the high-profile nature of the petitioner but also because of the underlying questions regarding the balance between legal proceedings and legislative duties.
