Supreme Court Stays High Court’s Strict Remarks Against Haryana’s Add. Advocate General

The Supreme Court Today (Feb 17) stayed the Punjab and Haryana High Court’s strictures against Haryana’s Additional Advocate General Deepak Sabharwal. The High Court had criticized him for misleading the court regarding an accused’s medical bail.

Supreme Court Stays High Court’s Strict Remarks Against Haryana's Add. Advocate General

NEW DELHI: The Supreme Court of India today temporarily halted the strict remarks recently made by the Punjab and Haryana High Court against Haryana’s Additional Advocate General, Deepak Sabharwal.

This order was passed by a bench consisting of Justice BV Nagarathna and Justice Satish Chandra Sharma, following a plea filed by the Haryana government.

“Anything can be said against the party. But passing strictures against the counsel cannot happen,”

-the Court stated as it stayed the remarks against Sabharwal.

The Punjab and Haryana High Court had previously criticized Sabharwal for allegedly making misleading statements to oppose the medical bail plea of an accused.

The High Court had passed the order last month, saying that Sabharwal’s submissions were inaccurate.

The counsel for the state had told the Court that the accused was stable, but the accused later passed away in the hospital.

“Suppressing material facts, misrepresenting or misleading the Court in any manner constitutes a serious violation of prosecutorial ethics and an affront to judicial integrity,”

-Justice Manjari Nehru Kaul had observed in the order passed on January 31.

Following this, the Haryana government approached the Supreme Court for relief.

Solicitor General Tushar Mehta represented the Haryana government.

Senior Advocate Shoeb Alam appeared for the respondent in the case.
