NEW DELHI: Today(on 1st April), The Supreme Court of India has requested a response from the Tamil Nadu Directorate of Vigilance and Anti-Corruption (DVAC) regarding the default bail plea filed by Ankit Tiwari, an officer of the Enforcement Directorate (ED).
This decision was made by a bench consisting of Justice Surya Kant and KV Viswanathan, who have scheduled a review of the plea within four weeks. Additionally, they have connected the case with Tiwari’s existing regular bail plea.
Advocate Shivam Singh, who represented Tiwari in court.
The case originated in December of the preceding year when Tiwari was apprehended by the DVAC on allegations of accepting a bribe of Rs. 20 lakh from a medical professional in Dindigul. Subsequently, after Tiwari’s arrest, the Supreme Court not only granted him temporary release from custody but also suspended the DVAC’s inquiry into the incident.

A petition has been filed, contesting the Madras High Court’s decision to reject Tiwari’s plea for default bail. Justice M. Dhandapani, presiding over the Madurai bench of the High Court, delivered this ruling on March 15, dismissing the ED officer’s appeal against a local court’s refusal to grant statutory bail.
In his verdict, Justice Dhandapani emphasized the delicate equilibrium between an individual’s right to personal freedom and the ongoing legal proceedings. He pointed out that the DVAC’s inability to submit a chargesheet was directly affected by the Supreme Court’s temporary halt of the investigation on January 25—55 days into the DVAC’s inquiry.

The ED’s decision to appeal to the Supreme Court for transferring the ongoing investigation to the Central Bureau of Investigation (CBI) was acknowledged by the Supreme Court, which issued a notice on January 25th.
