Today, 29th April, The Supreme Court revoked the bail granted by the High Court to a high-profile Karnataka Seer in a POCSO case, mandating his surrender. The case involves serious allegations under the Protection of Children from Sexual Offences (POCSO) Act. This decision reflects the judiciary’s commitment to ensuring fair trial proceedings and addressing sensitive matters promptly. New Delhi: The Supreme Court, on Monday, reversed a decision by the Karnataka High Court that allowed Seer Shivamurthy Murugha Sharanaru to be released on bail. Shivamurthy, who faces allegations of sexually assaulting minor girls, initially granted bail on November 8, 2023. However, upon reviewing a petition from the father of one of the minor victims, the Supreme Court directed the revocation of Shivamurthy’s bail and ordered his arrest within one week.
The Court highlighted concerns that Shivamurthy, being a powerful and influential figure, could potentially interfere with the trial process by influencing witnesses and victims. To ensure a fair trial for both the accused and the victims, the Supreme Court found it necessary for Shivamurthy to remain in custody while the witnesses get examined.

During the proceedings, the Supreme Court bench, comprising Justices Vikram Nath and Prashant Kumar Mishra, emphasized their decision to focus solely on the bail issue to avoid prejudicing the trial’s outcome.
They stated,
“It is prima facie viewed that to ensure a fair trial not only to the accused but also to the victims, it would be in the interest of justice that Shivamurthy Murugha Sharanaru remains in custody during the time the witnesses of fact are examined.”
The Supreme Court also issued directives for the trial to be expedited. The Trial Court instructed to reframe the charges against Shivamurthy and to proceed with the trial as swiftly as possible, ideally on a day-to-day basis. This to ensure that all factual witnesses are examined within four months.

The Court expressed,
“We shall refrain from delving into the merits of the case as it could potentially impact the trial proceedings.”
Additionally, the Supreme Court extended a caution regarding the conduct of the parties involved in the trial, noting that any attempts to unnecessarily delay the proceedings should be documented and reported to the higher court.
