The petition was filed by advocate C R Jaya Sukin.
The bench, while hearing the case, stated that it was already dealing with matters related to certain bills that have been passed.
“We are already examining matters where certain bills have been passed…,” the bench remarked during the proceedings.
The petitioner, advocate Jaya Sukin, argued that the governor’s actions violated the Constitution of India.
In response, the Supreme Court bench rejected this claim. “He cannot…,” said the Chief Justice.
The bench further clarified, “Wherever we found there is an issue, we have issued notice and the matter is pending….this prayer (seeking direction to recall the governor) which you have made is not possible. We cannot grant that. We are also bound by the Constitution…”
The petition had suggested that the Governor of Tamil Nadu should not intervene in political matters and must act only within the powers specified by the Constitution. The plea highlighted a series of Supreme Court judgments that reinforced the idea that a governor should not engage in politics but should only perform the functions allocated to them by the Constitution.
It further argued that the Governor should be mindful of the limits of his constitutional powers and refrain from acting outside the scope defined by the Constitution or related laws. The plea also criticized Governor Ravi for allegedly tying the Dravidian ideology to outdated ideas that foster separatism.
According to the petitioner, the Governor’s actions have created an environment that undermines national unity and the concept of “One India.”
Additionally, the plea highlighted incidents where the Tamil Nadu Governor’s actions were seen as disrespectful to the state’s culture. Specifically, the petitioner referred to an incident on January 6, when Governor R N Ravi walked out of the Tamil Nadu Legislative Assembly just after the session started. The Governor’s action was in protest against the national anthem not being played in the House, which the petitioner argued was a sign of disrespect.
