‘No Sympathy For You’: Supreme Court Rejects Plea of Advocate Contesting Bar Elections During Suspension

NEW DELHI: On December 3, the Supreme Court declined to intervene in the Bar Council of India’s decision to suspend an advocate for five years due to misconduct. The Court also expressed concern over the advocate’s participation in the Bar Association elections in Uttar Pradesh while under suspension.

The bench, comprising Chief Justice Sanjiv Khanna and Justice Sanjay Kumar, was hearing an appeal from the advocate, who had been suspended by the Bar Council of India’s disciplinary committee on March 11, 2022.

During the suspension, the advocate contested Bar Association elections. The Chief Justice Sanjiv Khanna took a strong stance on this matter, highlighting the advocate’s actions.

“You wore the band, posted thank you messages online, and campaigned for donations,” the CJI noted. “By running in the elections and behaving this way, you don’t deserve any sympathy.”

The petitioner’s counsel argued for a reduction in the suspension period, citing the 2.9 years already served and the impact on the advocate’s livelihood.

The Court dismissed the appeal, stating: “Considering the appellant’s conduct, we find no valid grounds to modify the sentence, and the appeal is rejected.”
