A woman judge from Jharkhand went to the Supreme Court after being denied child care leave. The Supreme Court Today (May 29) asked the High Court to reply within a week.
Thank you for reading this post, don't forget to subscribe!NEW DELHI: The Supreme Court of India today asked the Jharkhand High Court to give its response in one week regarding a complaint made by a woman judge from the state.
This woman judge, who works as an Additional District Judge and is a single parent, approached the Supreme Court after being denied her request for child care leave.
A Bench led by the Chief Justice of India, CJI BR Gavai, along with Justice AG Masih, issued a notice to the Jharkhand High Court.
The court said:
“(Notice) returnable in one week. Liberty to serve standing counsel of Jharkhand. Let the High Court be served through email. Parties are put on notice and we shall dispose it of on the next date.”
The judge’s lawyer told the Supreme Court that the judge is very sincere in her work and performs her duties well.
The lawyer also explained that the judge had asked for six months of child care leave, which is allowed under the rules.
The lawyer said:
“Please see her Annual Confidential Records. She was fantastic … she sought 6 months child care leave. High Court allows 730 days.”
However, the Bench asked the lawyer why the judge did not first try to get help from the Jharkhand High Court itself before coming to the Supreme Court.
The lawyer replied that the matter is urgent, but according to the High Court rules, her request would only be heard after the summer vacation.
So, the Supreme Court agreed to look into the matter quickly and told the Jharkhand High Court to give a reply soon. The top court will take a final decision in the next hearing.
