Supreme Court Directs MP High Court to Re-examine Decision to Terminate Services of Six Women Civil Judges

On Monday(22nd July),The Supreme Court has directed the Madhya Pradesh High Court to reexamine its decision to terminate six women civil judges and review their cases within a month. The Court also requested that the High Court submit a copy of its resolution to the Supreme Court within four weeks.

Supreme Court Directs MP High Court to Reconsider Termination of Six Women Civil Judges

NEW DELHI: The Supreme Court on Monday(22nd July), directed the Madhya Pradesh High Court to reexamine its decision to terminate the services of six women civil judges. The directive was issued by a Bench comprising Justices BV Nagarathna and N Kotiswar Singh.

“We ask the full court of the Madhya Pradesh High Court to review the cases of these judicial officers. After reconsideration, please submit a copy of the resolution to this Court within four weeks, if possible.”

– the Court ordered.

The Supreme Court had taken suo motu cognizance in January of the termination of these six judges by the Madhya Pradesh government. The State government had acted on the recommendation of the High Court, leading to the termination of their services in June 2023.

The orders for termination were issued by the law department following an administrative committee meeting and a full court session that deemed their performance during the probation period as unsatisfactory.

The Supreme Court, recognizing the gravity of the matter, appointed Senior Advocate Gaurav Agrawal as Amicus Curiae to assist the Court. The bench issued a notice to the Madhya Pradesh High Court to present its stance on the issue.

In an earlier hearing, the bench had questioned the High Court’s willingness to reconsider its decision. The Amicus Curiae, during the hearing on Tuesday, suggested that the High Court should reassess its previous ruling.

Taking into account the recommendation from the Amicus Curiae, the Supreme Court issued an order asking the Madhya Pradesh High Court to reevaluate the matter.

The Madhya Pradesh High Court is now tasked with revisiting its decision within a month. The Supreme Court expects a comprehensive review and has asked for the resolution to be submitted to the apex court for further consideration.
