Supreme Court’s Controversial Remark on Bail Delays: “That Is Why There Is Some Peace In Bihar”

NEW DELHI: The Supreme Court yesterday (feb 24), made a thought-provoking and somewhat controversial remark about the long delays in bail cases in Bihar.

A Bench of Justice Vikram Nath and Justice Sandeep Mehta commented that these delays might actually be the reason Bihar remains peaceful.

This observation came when a lawyer highlighted that bail cases in Bihar often remain pending for as long as nine months.

“Please give direction that the trial court should expedite the trial. In Bihar, bail matters are pending for nine months,”

-the lawyer pleaded.

In response, Justice Vikram Nath made a striking remark:

“That is why there is some peace in Bihar.”

Following this, the Court refused to direct the trial court to speed up the trial process after declining to grant bail to the petitioner.

However, the Court allowed the petitioner, Nandan Mahto, the option to withdraw his petition and apply for bail directly before the trial court.

“This petition is, accordingly, dismissed as withdrawn with liberty to the petitioner to surrender within two weeks from today and apply for regular bail before the Trial Court. If such a prayer is made, the same shall be considered by the Trial Court on its own merits,”

-the Court ordered.
