This PIL challenges the current state of unregulated sex change surgeries within the nation.
The bench, led by Chief Justice D Y Chandrachud and including Justices J B Pardiwala and Manoj Misra, responded to the advocacy of Gopi Shankar M, a resident of Madurai who brought the petition forward. The petitioner underscored a critical concern: intersex individuals, upon reaching adulthood, find themselves disenfranchised, lacking recognition as voters within the democratic fabric of the country.
The Supreme Court’s directive, “Issue notice,” sets the stage for a thorough examination of these pressing issues, with Additional Solicitor General Aishwarya Bhati being enlisted to aid in the adjudication of the PIL.
The attorney representing the petitioner highlighted that the medical practices involved in sex change surgeries are considered punishable offenses in various other legal jurisdictions, emphasizing the need for scrutiny and regulation within India.
The PIL casts a wide net in seeking accountability and action, naming the Union ministries of Home Affairs, Social Justice and Empowerment, Health and Family Welfare, Law and Justice, and Women and Child Development as respondents.
Furthermore, it includes the Registrar General and the Census Commissioner of India, alongside CARA, urging a comprehensive approach to address the legal, social, and medical facets of the challenges faced by intersex individuals in India.
