Bench noted that the prosecution and arguing counsel were not in sync with case details regarding when the the chargesheet was filed.

The bench, consisting of Justices Hrishikesh Roy and SVN Bhatti, expressed concern over the inability of the state’s legal team to clarify when the chargesheet in the case was filed.
The court expressed surprise at the lack of communication and coordination between the prosecution and the government counsel, stating,
“We are indeed surprised by the response of the Government counsel as the respective dates of filing of the chargesheets should either be readily accessible or the instructing officer should have indicated the relevant dates of the chargesheets… The disconnect between the prosecution and the Government counsel is clearly discernible.”
As a result, the Supreme Court ordered the Telangana DGP to be present before the bench on October 4, either in person or via video conference, to provide clarity on the chargesheet’s filing dates. The court also directed state counsel to ensure they have all the relevant details and information regarding the chargesheet for the next hearing.
The Case Involves Bahujan Samaj Party Leader Vatti Janaiah Yadav
The case stems from a plea filed by Vatti Janaiah Yadav, a Bahujan Samaj Party (BSP) leader, who previously belonged to the Bharat Rashtra Samithi (BRS). Yadav had approached the Supreme Court in 2022, alleging that he was being criminally persecuted by the BRS-led Telangana government after his decision to switch parties from BRS to BSP. He claimed that multiple First Information Reports (FIRs) had been lodged against him as a result of political vendetta.
In response to his plea, the Supreme Court had on October 6, 2022, sought the Telangana government’s explanation and granted Yadav interim protection from arrest in connection with thirteen FIRs registered against him.
Yadav, a candidate in the 2023 Telangana Assembly elections, had unsuccessfully contested from the Suryapet constituency, where he was defeated by the BRS candidate.
Supreme Court Criticizes Lack of Coordination
The court’s rebuke highlights a serious lapse in communication within the Telangana government’s legal machinery. The Supreme Court noted that the lack of synchronization between the prosecution and the state counsel was “clearly discernible,” pointing to an evident disconnect in how the case was being handled. Such remarks reflect the court’s concern over the proper management of legal processes, particularly in politically sensitive cases.
The presence of the Telangana DGP before the Supreme Court is now a crucial step to clarify the discrepancies surrounding the chargesheet in the case and ensure that the judicial process is not hampered by administrative shortcomings.
