SC Slams UP Gov. for filing Appeal against Order to pay pension to Retd. Gov. Servants

A vacation bench comprising Justice Abhay Oka and Justice Rajesh Bindal expressed their concern over the state’s tendency to bring routine pension disputes to the apex court.

NEW DELHI: Today (25th June): The Supreme Court strongly criticized the State of Uttar Pradesh for filing appeals to challenge orders directing the payment of pensions to retired government servants.

A vacation bench comprising Justice Abhay Oka and Justice Rajesh Bindal expressed their concern over the state’s tendency to bring routine pension disputes to the apex court.

“Why is the State coming to the Supreme Court to stop someone from receiving their pension? What is going on? Why are you preventing someone from getting their pension? The State repeatedly challenges the grant of pension,” Justice Oka remarked orally.

Despite the State of Uttar Pradesh’s counsel arguing that the pensioner in question was employed on an ad-hoc basis and that the Allahabad High Court’s decision to grant the pension contained errors, Justice Oka responded that a person who has worked for many years deserves a pension.

“The Supreme Court is not meant for such matters. Someone who has worked for so many years is entitled to a pension,” he stated before dismissing the appeal.
