The bench of Justices Bela M Trivedi and Satish Chandra Sharma stated that Malik’s medical bail will be valid until the disposal of his regular bail plea before the Bombay High Court.
The Additional Solicitor General, SV Raju, who represented the Enforcement Directorate (ED), did not oppose the grant of bail and said the interim medical bail may be made permanent.
Malik, who was arrested by the ED in February 2022, had sought relief from the high court, claiming he was suffering from a chronic kidney disease and various other ailments. The ED’s case against Malik is based on an FIR filed by the National Investigation Agency (NIA) against fugitive gangster Dawood Ibrahim and his associates under the Unlawful Activities (Prevention) Act.
This decision by the Supreme Court provides a temporary relief for Malik, who will now be able to seek medical attention while the legal proceedings continue. The case has garnered significant attention due to the high-profile nature of the accused and the allegations of money laundering and links to organized crime.
