Sandeshkhali Row | West Bengal Seeks Urgent Listing of Plea in SC Against Transfer of Probe to CBI

NEW DELHI: The West Bengal government Today sought urgent listing of its plea in the Supreme Court challenging a Calcutta High Court order to transfer to the CBI the probe into an attack on Enforcement Directorate officials in Sandeshkhali on January 5.

“You move an application. The CJI takes note of (urgent listing) applications during lunch hour. He will order listing of the plea,”
-Justice Sanjiv Khanna said responding to the plea.

Initially, senior advocate Abhishek Singhvi, representing the West Bengal government, brought up the plea before a bench comprising Justices Sanjiv Khanna and Dipankar Datta.

Singhvi emphasized that the central probe agency was pushing for immediate compliance with the High Court’s directive to transfer the investigation to them.

Furthermore, the state government had also sought an urgent listing of the plea on Tuesday evening.

Responding to this urgency, the bench instructed the state government’s counsel to raise the matter with the Registrar General of the Supreme Court.

Both the Enforcement Directorate (ED) and the West Bengal government separately filed appeals in the High Court against a single bench order issued on January 17. This order had mandated the formation of a joint Special Investigation Team (SIT) comprising the CBI and the state police to investigate the mob attack on the ED officials in Sandeshkhali.

While the ED insisted on sole transfer of the probe to the CBI, the state government argued for the investigation to remain with its police force.

Consequently, the High Court, acceding to the ED’s request, directed the transfer of TMC leader Shajahan Sheikh’s custody, arrested by the West Bengal Police on February 29 in connection with the attack, to the central agency.
