The Supreme Court stated that reforms are necessary within the Supreme Court Bar Association (SCBA). It expressed its willingness to establish a committee to identify key recommendations for these reforms.
New Delhi: The Supreme Court, highlighted the necessity for reforms within the Supreme Court Bar Association (SCBA), asserting its commitment to implementing these changes with the bar’s support and cooperation.
The bench, comprising Justice Surya Kant and Justice Ujjal Bhuyan, emphasized the importance of contributions from SCBA members, inviting their valuable suggestions to drive the reform process.
Justice Kant remarked,
“We are firm that some reforms are required in the SCBA, and we are prepared to carry them out with the bar’s support and cooperation.”
The Court indicated its intent to form a committee to evaluate and streamline the suggestions received, aiming for a more effective implementation of the proposed changes.
SCBA President and senior advocate Kapil Sibal informed the Court that he still in the process of collating the suggestions that had already been submitted. The Court then inquired whether the orders it had previously issued had been incorporated into the SCBA rules.
Sibal requested additional time to review the matter and provide a detailed response. In response, the Court proposed the formation of a committee to assist in streamlining the suggestions, agreeing with Sibal’s point that the committee could include experienced members of the bar who had witnessed the association’s growth over the years.
Previously, the Court instructed the SCBA to solicit reform suggestions from its members. One notable directive from the Court was the experimental reservation of one-third of the seats on the SCBA’s executive committee for women.
The Court highlighted that the SCBA, as a premier institution, must evolve its rules to address contemporary challenges effectively, stating that,
“Its rules cannot remain static.”
This call for reforms, a significant step towards strengthening the SCBA’s role in supporting the legal profession and upholding the integrity of the judiciary. It reflects the Supreme Court‘s proactive approach in fostering a more robust and responsive bar association that can better serve its members and the public.
