Today, On 17th December, Supreme Court said such quorum shopping is unacceptable, as CJI Surya Kant reacted to allegations against trial court judges. Senior Advocate Indira Jaising flagged last-minute complaints made to High Courts, leaving cases stranded when orders are due imminent.

In a recent discussion in the Supreme Court, Senior Advocate Indira Jaising highlighted the serious issues arising from allegations made against a trial court judge.

She stated,

“Serious allegations are made against the trail court judge just when everything is complete the order is about to be passed and now the cases are left stranded. Complaints are made to the HC.”

The Chief Justice of India (CJI) responded, emphasizing the need for judicial firmness.

He remarked,

“This kind of quorum shopping is not ok. The judge should deal with this firmly and go on to decide the case without any bias.”

Jaising further pointed out that judges often face transfers based on unverified claims, adding,

“The judge gets transferred on the basis of such false and frivolous claims.”

The Supreme Court’s remarks underline the importance of maintaining impartiality and ensuring that judges can conclude cases without undue influence or fear of baseless complaints.

This development comes amid increasing concerns about “quorum shopping,” where parties attempt to influence judicial decisions by raising last-minute complaints, potentially affecting the outcome of cases.
