The case, which previously appeared before Justice Pardiwala, who had also directed that it be listed high on the board, temporarily disappeared from the cause list, prompting concern from the petitioners.
During the brief hearing, Chief Justice of India (CJI) Surya Kant remarked that the issue should appropriately be placed before a three-judge bench, given the constitutional questions involved, including federalism concerns and whether the regulation of online gaming falls within the legislative ambit of the Centre or the States.
Appearing for the petitioners, counsel stressed that extensive submissions have already been made, particularly on the question of legislative competence. The counsel expressed urgent concern over the impact of the Act, noting:
“People are now left unemployed.”
The petitioners argued that the delay in adjudicating the matter is causing widespread issues for those working in the online gaming and related tech sectors.

Solicitor General Tushar Mehta responded by stating that the unemployment concerns constitute a separate issue and cannot influence the core determination of the Act’s validity.
The Supreme Court has now listed the matter for hearing in January, where it is expected to be taken up by a three-judge bench.
