The petitions, filed after the Vigilance Court refused to initiate probes, argued that there were serious grounds for investigation. The Kerala High Court had earlier held that all alleged acts were “only based on suspicion,” refusing to direct any inquiry.
During the Supreme Court hearing, the petitioner’s counsel contended that the High Court erred in dismissing the petitions.
“The High Court acknowledged that my petition is not motivated, and at some stage recognized that there is something worth examining,”
the counsel argued.
He added,
“Three facts are undeniable. The High Court says that complaints at the pre-cognizance stage should be based on proven facts. The High Court cannot demand proven facts at this stage, yet issue notice to the Public Prosecutor and give a clean chit to the accused.”
The Bench, however, remained firm in its stance. Chief Justice of India remarked,
“We have repeatedly stated that this forum should not be used for political battles.”
Justice Chandran also noted that the petitioner had been actively involved in the rescue operations.
Ultimately, the Supreme Court declined to interfere with the Kerala High Court’s decision, effectively upholding the dismissal of the petitions.
