NEW DELHI: The Supreme Court of India on Monday firmly rejected an appeal by the Enforcement Directorate (ED). The appeal was against the Karnataka High Court’s earlier decision that cancelled the summons issued to Karnataka Chief Minister Siddaramaiah’s wife, BM Parvathi, in the alleged Mysore Urban Development Authority (MUDA) land scam case.

A Supreme Court Bench led by Chief Justice of India BR Gavai and Justice K Vinod Chandran made serious observations regarding the misuse of central investigative agencies in political matters.

They directly questioned why the ED was being involved in such cases, which appear to have political undertones.

The Court said clearly:

“Unfortunately, I have some experience in Maharashtra. Please do not force us to say something. Otherwise we have to say something very harsh about the Enforcement Directorate (ED). Let political battles be fought among the electorate. Why are you being used for it?”

Hearing this, Additional Solicitor General (ASG) SV Raju, appearing for the ED, responded by saying:

“Okay, we will withdraw. But let it not be treated as a precedent.”

The Supreme Court then went ahead and dismissed the ED’s appeal.

The judges appreciated the reasoning behind the Karnataka High Court’s earlier judgment which had quashed the ED’s summons. They found no legal fault in that decision.

The top court said:

“We do not find any error in reasoning adopted in approach of single judge. In peculiar facts and circumstances, we dismiss it. We should thank you ASG for saving some harsh comments.”

The Court emphasized again:

“Let political battles be fought among the electorate. Why are you being used for it?”

The case is related to allegations of corruption and irregularities in land allocation by MUDA. The complaint states that BM Parvathi, wife of CM Siddaramaiah, received a land parcel of more than three acres as a “gift” from her brother, Swamy.

Originally, this land was acquired by the government but later de-notified and bought by Swamy.

Even though the land was under private ownership, it was developed by MUDA, which is a violation. After this, Parvathi reportedly asked for compensation. Allegedly, she received much higher compensation than normal, including 14 well-developed alternate land plots, through a 50:50 scheme, which is highly controversial. These plots were valued much more than the original land given up.

Later, Parvathi surrendered the land back to the authorities, according to reports.

Earlier, on March 7, Justice M Nagaprasanna of the Karnataka High Court had quashed the ED summons to BM Parvathi. The same judge also cancelled summons to Minister Byrathi Suresh, who was not even an accused in the case but was called for questioning by the ED.

The ED then approached the Supreme Court, challenging the High Court’s decision
