NEW DELHI: The Delhi High Court on Friday told social media companies and pornographic websites to immediately remove deepfake and AI-made obscene photos and videos that wrongly showed a popular woman influencer in a bad and disrespectful way.

Justice Purushaindra Kumar Kaurav gave a temporary order (interim injunction) and said-

“The content shared online is completely appalling, deplorable, defamatory, and is a patent breach of the fundamental rights of the plaintiff”.

The influencer had gone to the Delhi High Court for help, saying that some people had uploaded edited and fake photos and videos of her on social media and porn sites. These fake images made it look like she was involved in inappropriate activities, which was false and hurtful to her dignity.

She told the court that this fake content was not just a personal attack but also broke her fundamental rights like the right to privacy, reputation and dignity. Her lawyer said it was also a civil wrong, meaning that it could lead to legal punishment under civil laws.

After hearing the complaint, the judge agreed and gave support to her claims. The judge passed an order to stop further spreading of these images and videos.

The judge also allowed the influencer to tell the involved social media platforms and porn websites (called defendant Nos. 28 to 31) about any new fake URLs she finds in the future. Those websites must remove the fake content once they get such notice.

“The plaintiff is at liberty to notify defendant Nos. 28 to 31 or any other intermediary platforms/website(s), of any subsequently discovered URLs containing the offending Suit images or identical content, as found on their respective social media platforms and/or websites, which shall be acted upon by the said defendants,”

The Court didn’t just stop at takedown orders. It also told Meta (Facebook) and X Corp (Twitter) to give full details of the people or accounts who had first shared these fake and harmful posts. The Court wants to trace the origin of these fake and obscene posts.

To protect the woman’s privacy during the legal process, the judge also said that her name and identity should not be made public in any court records.

“Considering the confidentiality of the instant matter, the Registry is directed to delete the name and other details of the plaintiff from the memo of parties and take appropriate steps to amend the cause title in accordance with extant rules.”

This shows how serious the Court is about keeping her identity safe and preventing more damage to her reputation.
