The bench stated.
“On that day, the petitioner is at liberty to press for early disposal of this case. It is needless to observe that the same shall be considered having regard to the facts of the case as alleged by the petitioner’s wife,”
The Supreme Court clarified that the four-month timeframe was necessary because the high court has imposed a stay on the summons issued to the Kunda MLA by the trial court.
Raja Bhaiya faces allegations of domestic violence following a complaint from his wife, resulting in an FIR registered at Delhi’s Safdarjung Enclave police station.
The complaint was lodged by Bhanvi Singh, who alleged that her husband subjected her to prolonged physical and psychological abuse, resulting in serious and permanent injuries. She claimed to have endured repeated assaults causing lasting harm to various parts of her body, alongside sustained mental cruelty, leaving her in constant fear for her safety.
Bhanvi stated that the couple has been living apart for several years due to the breakdown of their marital relationship. She also accused her in-laws, including her mother-in-law, of persistent harassment. According to her, she initially chose not to initiate legal proceedings in the hope of preserving family harmony and safeguarding her marriage, but the alleged abuse continued unabated.
She further disclosed that she had earlier approached the National Commission for Women and the Delhi State Legal Services Authority with similar grievances, though those proceedings were not carried forward.
Subsequently, in August 2023, Bhanvi submitted an affidavit before a family court, accusing Raja Bhaiya of sustained domestic violence, mental and physical cruelty, and extramarital relationships extending over nearly three decades.
