The Supreme Court Bench Led by CJI, Today (August 8th) said it has listed for hearing on August 9 a plea challenging the verdict of the Bombay High Court which had upheld a decision of a Mumbai college to impose a ban on wearing of hijab, burqa and naqab inside the campus.

The verdict in question upheld a Mumbai college’s decision to ban the wearing of ‘hijab,’ ‘burqa,’ and ‘naqab’ inside the campus.
A bench comprising Chief Justice D Y Chandrachud and justices JB Pardiwala and Manoj Misra acknowledged the urgency of the matter, noting the submissions of a lawyer who pointed out that term exams are starting today. The lawyer emphasized that students from a minority community would face difficulties due to the dress code instructions.
Lawyer Abiha Zaidi, representing the petitioners, including Zainab Abdul Qayyum, sought an urgent hearing, stating that unit tests in the college are commencing.
The CJI responded,
“It is coming up tomorrow (Friday). I have listed it already.”
Previously, on June 26, the Bombay High Court had refused to interfere with the decision made by the Chembur Trombay Education Society’s N G Acharya and D K Marathe College.
The college had imposed the ban on certain dress items, arguing that such rules do not violate students’ fundamental rights. The high court noted that a dress code is intended to maintain discipline, which is part of the college’s fundamental right to
“establish and administer an educational institution.”
