Supreme Court of India Declines Former Jharkhand Chief Minister Hemant Soren’s Plea, Denying Protection from Enforcement Directorate (ED) Arrest Among Land Fraud Allegations.

On February 2, 2024, the Supreme Court of India made a significant decision. They refused to consider a request from former Jharkhand Chief Minister Hemant Soren. He was seeking protection from arrest by the Enforcement Directorate (ED) in a case related to land fraud allegations. Instead, the Supreme Court directed Soren to seek help from the Jharkhand High Court, emphasizing the proper legal process for such matters.

Hemant Soren, a well-known political leader and the head of the Jharkhand Mukti Morcha (JMM), is facing legal trouble after being arrested by the Enforcement Directorate (ED). The charges against him involve a land scam and money laundering. This case has gained a lot of attention due to its potential impact on politics and governance in Jharkhand.
During a session led by Justices Sanjiv Khanna, MM Sundresh, and Bela M Trivedi, the Supreme Court questioned the need to skip the high court in the matter. Senior Advocates Kapil Sibal and Abhishek Manu Singhvi, representing Hemant Soren, argued for the Supreme Court’s involvement due to the case’s exceptional nature and Soren’s position as a former chief minister.

However, Justice Khanna highlighted the importance of following the regular judicial process, saying,
“First, courts are open to everybody. Second, high courts are constitutional courts. If we permit one person to come here, we will have to allow everyone.”
This conversation highlights the court’s reasoning in directing Soren to the high court, maintaining the integrity of the judicial hierarchy and process.
The Enforcement Directorate is looking into Hemant Soren for allegations of money laundering related to an illegal mining case and a land scam in Ranchi. Several people, including an IAS officer and a businessman, have been arrested in connection with this case. Soren, a prominent figure, is the latest high-profile person involved. The charges from the Enforcement Directorate suggest that Soren was part of acquiring, possessing, and using properties considered proceeds of crime. This raises significant concerns about the legality of his actions and has broader implications for governance in Jharkhand.
Hemant Soren’s arrest has not only legal consequences but also significant political implications, especially with the upcoming General Elections. Soren’s legal team argues that his arrest is part of a broader political strategy.
Senior Advocate Kapil Sibal stated,
“They are trying to topple this government, that’s a fact.”
This highlights the complex relationship between legal actions and political strategies, adding to the controversy surrounding Soren’s legal battle.
Soren’s defense challenges the jurisdiction of the criminal proceedings against him, claiming there is no direct link between him and the alleged proceeds of crime. They also suggest that the land in question might be “bhuinhari” land, which cannot be legally transferred, adding further complexity to the legal aspects of the case.
