The Supreme Court granted interim protection from arrest to folk singer Neha Singh Rathore in a case linked to her social media remarks on the Pahalgam terror attack. The Court directed her to cooperate with the investigation while ordering that no coercive action be taken at this stage.

New Delhi: The Supreme Court on Wednesday gave interim protection from arrest to folk singer Neha Singh Rathore in a case registered against her over a social media post related to the Pahalgam terror attack.
The case arises from comments allegedly made by Rathore on social media after the killing of 26 tourists in Pahalgam, Jammu and Kashmir. According to the allegations, her posts targeted Prime Minister Narendra Modi, Union Home Minister Amit Shah, and the Bharatiya Janata Party (BJP).
A Bench of Justices JK Maheshwari and Atul S Chandurkar issued notice to the Uttar Pradesh government and the original complainant in the matter. The Court made it clear that no coercive steps should be taken against Rathore for the time being.
At the same time, the Supreme Court directed her to appear before the Investigating Officer and fully cooperate with the ongoing investigation.
Earlier, on December 5 last year, the Lucknow Bench of the Allahabad High Court had rejected Rathore’s anticipatory bail plea. The High Court had observed that she did not cooperate with the investigation, despite directions issued by an earlier bench which had dismissed her petition seeking quashing of the FIR.
The FIR against Rathore was registered on April 27 at the Hazratganj Police Station in Lucknow, and the investigation is still underway.
The complaint was filed by Abhay Pratap Singh, who alleged that Rathore had “repeatedly attempted to incite one community against another on religious grounds”.
As per the FIR, Rathore has been accused of targeting a particular religious community and acting in a manner that could threaten the unity and integrity of the country.
Challenging the FIR before the Supreme Court, Rathore argued that she has been falsely implicated under multiple provisions of the Bharatiya Nyaya Sanhita (BNS), including sections related to promoting communal hatred, disturbing public peace, and endangering the sovereignty, unity, and integrity of India. She has also been booked under provisions of the Information Technology Act.
With the Supreme Court’s interim order, Rathore has received temporary relief from arrest, subject to her cooperation with the investigation, while the Court continues to examine the matter.
