New Delhi: Today (15th July): The Supreme Court denied interim bail to activist Jyoti Jagtap, who is imprisoned in connection with the Elgar Parishad–Maoist links case. A bench of justices MM Sundresh and Aravind Kumar also postponed the hearing on her main bail plea.

“We are not inclined to give interim bail,”
stated Justice Sundresh.
Jagtap appealed to the apex court against the October 17, 2022, high court decision that denied her bail, citing the National Investigation Agency’s (NIA) case against her as “prima facie true” and alleging her involvement in a “larger conspiracy” by the banned CPI (Maoist) group.
The high court noted Jagtap’s active membership in the Kabir Kala Manch (KKM) group, which performed aggressive and highly provocative slogans during its stage play at the Elgar Parishad conclave on December 31, 2017, in Pune. The event took place at Shaniwarwada, an 18th-century palace-fort in Pune.
Jagtap, accused of singing and raising provocative slogans with other KKM members at the conclave, was arrested in September 2020 and has been held at Byculla women’s prison in Mumbai since then. Investigators claim the provocative speeches at the conclave incited violence at Koregaon-Bhima near Pune on January 1, 2018.

Jagtap faces charges under the Unlawful Activities (Prevention) Act.
Background
The Bhima Koregaon case stems from an event organized by leftist and Urban Naxal groups in Pune on December 31, 2017. The event allegedly aimed to incite Dalits and other communities, leading to widespread violence in Bhima Koregaon and other parts of Maharashtra. The National Investigation Agency (NIA) has implicated 15 individuals in this case, charging them with various offenses, including plotting terrorist activities and raising funds for sophisticated weapons.
The accused in the Bhima Koregaon case face multiple charges under various legal provisions. For instance, academician Anand Teltumbde is accused of tampering with evidence. Other individuals charged by the NIA include Sudhir Dhawale, Rona Wilson, Surendra Gadling, Shoma Sen, Mahesh Raut, P. Varavara Rao, Vernon Gonsalves, Arun Ferreira, Sudha Bharadwaj, Gautam Navlakha, Hany Babu, Ramesh Gaichor, Jyoti Jagtap, and Surendra Gorkhe.
The draft chargesheet also mentioned Father Stan Swamy, who has since passed away, leading to a cessation of proceedings against him. Several other accused individuals remain absconding.
The Supreme Court’s deferment of Jagtap’s bail plea extends her time in custody, highlighting the ongoing complexities and delays in resolving the Bhima Koregaon case.
