CJI Sanjiv Khanna had left for China last Monday to take part in the conference of Chief Justices of Supreme Courts of Shanghai Cooperation Organisation (SCO) countries, which was organized in Hangzhou, China.
Several former Chief Justices of India said that usually they would attend such SCO conferences only when the Supreme Court was closed for vacation.
They said,
“If such conferences clashed with the working of SC, then a senior judge was assigned to attend it.”
They also pointed out that even in 2023, when India itself hosted the SCO Chief Justices’ conference, the then CJI did not miss his judicial work in the courtroom even for a single day.
The Supreme Court had already scheduled a five-day holiday from April 10 to April 14. During this time, CJI Sanjiv Khanna had gone on vacation to Port Blair. After the holidays, he returned and held court sessions from April 15 to April 17.
However, on April 18, the court was closed again because of Good Friday, followed by the usual Saturday and Sunday weekend. When the court reopened on April 21, CJI Sanjiv Khanna had already left for China to attend the SCO conference.
Now, he is expected to come back and resume work on Today. After his return, he will have a very busy schedule ahead of him because he is going to retire soon, on May 13.
Before his retirement, Chief Justice Sanjiv Khanna has two very important and serious responsibilities to handle.
The first important task is to decide on the prayer made by more than 150 Muslim petitioners who have requested a stay on some provisions of the Waqf (Amendment) Act.
However, this prayer is being opposed by the Centre.
The second major task before his retirement is to decide the next steps regarding Justice Yashwant Varma.
A huge amount of cash was found at the official residence of Justice Yashwant Varma in Delhi on the night of March 14. Now, the CJI has to take a call on whether to order the filing of a First Information Report (FIR) against Justice Varma or to close the case altogether.
To properly inquire into this shocking incident, on March 22, Chief Justice Sanjiv Khanna had appointed a special three-member judicial panel.
