NEW DELHI: The Supreme Court of India delivered a significant ruling Yesterday (March 16th), emphasizing the principle of equality in the determination of pensionary benefits for retired high court judges. According to the Court, there should be no disparity in pension benefits between judges who were elevated from the bar and those who ascended from the district judiciary.
This landmark judgment was pronounced by a bench led by Chief Justice D Y Chandrachud, underscoring that the pensionary entitlements of a retired high court judge, irrespective of their professional background prior to elevation, should be calculated based on the last salary drawn in their capacity as a high court judge.
The bench, which also included Justices JB Pardiwala and Manoj Misra, dealt with this issue while adjudicating a case related to the pensionary benefits of a former judge from the Punjab and Haryana High Court. The ruling reflects the judiciary’s commitment to ensuring fair treatment and uniformity in the post-retirement benefits for all high court judges, regardless of the path they took to reach the bench.
This decision is expected to set a precedent for future cases concerning the pensionary rights of retired judges, promoting a sense of equality and justice within the judiciary system.
