Supreme Court Directs CBI To Verify Advocate’s Degree After Magadh University Flags Forgery

The Supreme Court has ordered the CBI to investigate if a lawyer’s B.Com degree from Magadh University is genuine or forged. The probe report must be submitted by November 3.

New Delhi: The Supreme Court of India has asked the Central Bureau of Investigation (CBI) to check whether a lawyer’s educational degree is real or fake after Magadh University said that his certificates were not genuine.

A bench of Justices Manoj Misra and Ujjal Bhuyan gave this order while hearing an appeal against a decision made earlier by the Bar Council of India’s disciplinary committee, which had looked into the matter.

Earlier, the Supreme Court had taken note of a letter written by the Controller of Examinations of Magadh University, Bodh Gaya. In that letter, the university had clearly stated that the lawyer’s marksheet and Bachelor of Commerce (B.Com) degree were

“forged and not issued from the university”.

Following this, the court asked the lawyer to submit photocopies of the degrees which he claimed to hold — one in commerce and another in law.

The lawyer then filed a photocopy of the degree which stated that he had passed the Bachelor of Commerce (Honours) examination for the three-year degree course held in August 1991 by Magadh University.

However, in his defense, the lawyer argued that the university’s records had been destroyed and therefore the degree might not be verifiable through the documents currently available.

Looking at these facts, the Supreme Court observed,

“We deem it appropriate to require the Central Bureau of Investigation, Delhi to do the investigation and ascertain whether the degree set up by the Petitioner of having passed the B.Com examination from Magadh University in the year 1991 is genuine or forged.”

The bench further directed the CBI to assign an officer to carry out this investigation and to submit a detailed report before the court on or before November 3.

This case raises serious questions about the authenticity of academic qualifications presented by lawyers and the responsibility of universities in maintaining accurate records.

The CBI’s findings will now play a crucial role in determining whether the lawyer’s claim of holding a B.Com degree from Magadh University is legitimate or based on forged documents.
