CBI & CVC Case Delays || ‘We Can’t Issue Blanket Directions, Approach HC as Well’: CJI Sanjiv Khanna

Today, On 18th March, The Supreme Court, led by CJI Sanjiv Khanna, addressed concerns over delays in resolving CBI and CVC cases. Emphasizing judicial discretion, CJI Khanna stated, “We cannot issue blanket directions. You may approach the High Court as well.” The court acknowledged that closure reports are sometimes filed, but further investigations can be permitted. The remarks came during a PIL hearing, highlighting the judiciary’s stance on case proceedings.

New Delhi: The Supreme Court while reviewing a Public Interest Litigation (PIL) concerning the significant delays in resolving cases with the Central Bureau of Investigation (CBI) and the Central Vigilance Commission (CVC).

The petition claims that these delays undermine the integrity of the justice system, adversely affecting the general public.

During the proceedings, the advocate for the petitioner emphasized,

“No counter has been filed in the last four years, and over 2,500 cases are pending with the CBI.”

He argued that such delays in investigations hinder justice delivery and raised concerns about the influence of powerful individuals on the operations of investigative agencies.

Chief Justice of India Sanjiv Khanna responded to these issues, stating,

“At times, closure reports are filed, and courts permit further investigation. We cannot issue blanket directions. You may approach the High Court as well.”

While the Supreme Court acknowledged the issues raised, it highlighted the necessity of following due process.

In reaction to the petition, the CJI instructed that a reply be submitted within four weeks, after which the petitioner can file a rejoinder.

The matter will be scheduled for further hearing once these submissions are completed.

The advocate also requested the appointment of an amicus curiae to assist with the case, to which CJI Sanjiv Khanna replied,

“We will consider it on the next date.”

Further legal developments are anticipated as the case unfolds, particularly regarding the backlog of cases within the CBI and CVC and their implications for the justice system.
