[Cattle-Smuggling Case] SC Urges Delhi HC to Expedite Bail Plea of TMC Leader’s Daughter

The Supreme Court issued this order for expedited processing after hearing Sukanya Mondal’s appeal against a May 24 Delhi High Court order, where a single judge adjourned the matter to July 12 after removing it from a part-heard batch of cases.

NEW DELHI: Today (7 June): The Supreme Court has directed the Delhi High Court to decide within three weeks on Sukanya Mondal’s bail plea concerning her arrest in a cattle-smuggling case. This directive will take effect after the High Court reopens following its summer break.

Sukanya Mondal is the daughter of Anubrata Mondal, a Trinamool Congress (TMC) leader who is also implicated in the case.

A Vacation Bench comprising Justices Aravind Kumar and Sandeep Mehta highlighted that Sukanya Mondal’s bail plea has been pending for over ten months. The Supreme Court issued this order for expedited processing after hearing Sukanya Mondal’s appeal against a May 24 Delhi High Court order, where a single judge adjourned the matter to July 12 after removing it from a part-heard batch of cases.

Sukanya Mondal’s appeal, filed by advocate Mrinal Kumar Sharma, highlighted that she has been in jail for over a year.

The appeal stated, “The bail application has been pending before the Hon’ble High Court for more than 10 months and has been listed 22 times. The petitioner is a woman who falls under the exception provided in the first proviso to Section 45(1) of the PMLA for granting bail.”

Senior advocate Vikas Pahwa, along with advocates Syed Arham Masud, Wasif Naushad, Sahil Saraswat, and Garvil Singh, appeared for Sukanya Mondal. Anubrata Mondal’s bail plea is also currently pending before the Supreme Court.

Anubrata Mondal was arrested in August 2022 in connection with the cattle-smuggling case, which involves allegations of cattle being illegally smuggled to Bangladesh through bribed Border Security Force (BSF) personnel.

It is alleged that Md. Enamul Haque, a prime accused, obtained illegal favors from Anubrata Mondal to facilitate the cattle movement through Birbhum and Murshidabad districts. Sukanya Mondal was arrested by the Enforcement Directorate (ED) in April 2023 for failing to explain a significant increase in her assets.
